Copyright and Intellectual Property
Effective date: October 29, 2026
Atlandrak respects the intellectual property rights of others and expects people who use Atlandrak to do the same. This policy explains how rights holders can report infringing content, how people can respond, and how we handle repeat infringers. It follows the notice-and-takedown principles of the Intellectual Property Code of the Philippines (Republic Act No. 8293), the United States Digital Millennium Copyright Act and the European Union Digital Services Act.
Reporting copyright infringement
If you believe content on Atlandrak infringes your copyright, send a notice through the contact form (topic "Report or appeal") or to atlandrak@gmail.com with:
- your full name and contact details (address, phone number and email);
- a description of the copyrighted work you claim is infringed;
- the exact address (URL) of each item you want removed;
- a statement that you have a good-faith belief that the use isn't authorized by the owner, its agent or the law;
- a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner;
- your physical or electronic signature.
Reporting trademark infringement
Send the same information, plus the trademark, its registration number and the country of registration, and an explanation of how the content may confuse people.
What happens next
- We review every complete notice promptly and remove or disable access to the content when the notice is valid.
- We tell the person who posted the content, including the name of the rights holder and the details of the notice, so they can respond.
- Private files in Vault that aren't shared with anyone are not distributed and are generally not subject to takedown, unless the law requires otherwise.
Counter-notice
If your content was removed and you believe it was a mistake or that you have the right to use it, send a counter-notice with your name and contact details, the removed content and where it appeared, a statement under penalty of perjury that you believe it was removed by mistake, your consent to the jurisdiction of the courts of your address (or of the Philippines if you live elsewhere), and your signature. We forward it to the person who reported it and may restore the content after 10 to 14 business days unless they tell us they have filed a court action.
Repeat infringers
We close the accounts of people who repeatedly infringe the rights of others.
Misuse
Knowingly false notices or counter-notices may expose the sender to liability for damages. Consider fair use, quotation and other exceptions before sending a notice.
